This document (together with all documents referred to herein) sets out the terms and conditions governing the use of this website — cashmerearoma.com (hereinafter the "Website" or the "Site").

Please read these Terms and Conditions, the Cookie Policy, the Privacy Policy, the Delivery Policy, and the Return Policy before using the Website. By accessing and using the Website, you expressly acknowledge the binding nature of these documents and undertake to comply with them.

1. DESCRIPTION OF ACTIVITY

CASHMERE AROMA GLOBAL S.R.L., with its registered office in Bucharest, Sector 2, Str. Tomovici Stelian no. 6, Office no. 1, identified by Tax ID (CUI) 55309683, registered with the Trade Register under no. J20266046681009, carries out the activity of online retail of perfumes and aromatherapy products through the online store cashmerearoma.com, hosted on the Shopify platform.

2. DEFINITIONS

  • Seller – CASHMERE AROMA GLOBAL S.R.L., the operator of the online store cashmerearoma.com;
  • Buyer – any individual over 16 years of age, or any legal entity or other legal person that places an Order on the Site;
  • Client – any individual over 16 years of age, or any legal entity that has or obtains access to Content, through any means of communication made available by the Seller (electronic, telephone, etc.);
  • Account – the section of the Site consisting of an email address and a password that allows the Buyer to place an Order and which contains information about the Client/Buyer and the Buyer's history on the Site. Creating an Account is optional — Orders may also be placed without an Account (guest checkout);
  • My Cart – the section of the Site that allows the Buyer/User to add Goods they wish to purchase, either at that moment or at a later time;
  • Site – the online store hosted at the web address cashmerearoma.com;
  • Order – an electronic document constituting a form of communication between the Seller and the Buyer through which the Buyer transmits to the Seller, via the Site, their intention to purchase Goods;
  • Goods – any product listed on the Site, including the products referred to in the Order, to be supplied by the Seller to the Buyer as a result of the Contract concluded;
  • Campaign – the act of displaying, for commercial purposes, a finite number of Goods with a limited and predefined stock, for a limited period of time set by the Seller;
  • Contract – the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer, within the meaning of Emergency Ordinance no. 34/2014;
  • Commercial communications / newsletter – any type of message sent (email, etc.) containing general and thematic information, information about products similar or complementary to those purchased, or information about promotional offers or prices.

3. GENERAL TERMS

3.1. By placing an Order on the Site, the Buyer agrees to the form of communication (email) through which the Seller conducts its commercial operations.

3.2. All products sold on the Site are genuine and will be delivered in appropriate, sealed packaging, accompanied by an invoice, in accordance with applicable legislation.

3.3. The product images shown on the Site are for informational purposes. For further details about product characteristics and other additional information, please contact us.

3.4. Product sale prices are displayed on the Site in the local currency of the Buyer's country, automatically detected based on their location, with currency conversion carried out through the Shopify platform (Shopify Payments); amounts are collected by the Seller in EUR. Displayed prices include VAT. Sale prices do not include delivery charges, which are shown separately when completing the Order. For any Order placed and confirmed, the Buyer will always pay the prices in effect on the Site at the time the Order was placed.

3.5. The placing of an Order by the Buyer and its acceptance by the Seller is equivalent to the conclusion of a contract, in accordance with applicable legislation. The notification received by the user by email immediately after placing the Order is for information purposes only and does not constitute confirmation of the Order. The Contract is deemed concluded between the Seller and the Buyer at the moment the Buyer receives, by email from the Seller, the notification that the Order has been shipped.

3.6. Ownership of the ordered products transfers at the moment the Order reaches the Buyer and the Buyer has fulfilled the payment obligation.

3.7. The Seller may refuse to fulfil an Order or may unilaterally cancel it for objective reasons, notifying the Buyer and refunding any amounts paid.

3.8. All information on the cashmerearoma.com website is the intellectual property of CASHMERE AROMA GLOBAL S.R.L., in accordance with Law no. 8/1996 on copyright and related rights. All content published on the Site (text, product descriptions, images, logo, colors, slogan, symbols, web graphic elements, etc.) may be used solely for the purpose of informing Users and Buyers. Copying, distributing, publishing, or incorporating the content into other materials outside the Site is strictly prohibited without the Seller's prior written consent.

3.9. The Seller is not liable for any color differences that may appear when viewing products on various electronic devices (desktop/tablet/mobile) of Users/Buyers.

3.10. The Seller reserves the right to change, modify, or update the content of the Site, as well as these Terms and Conditions of use, at any time, without prior notice. The updated version becomes binding as of the moment it is published on the Site.

4. ACCESS TO THE WEBSITE

4.1. Access to the Site is provided exclusively by accessing the public domain cashmerearoma.com.

4.2. By accessing and using the Site, the User/Client agrees to accept the Terms and Conditions presented on the Site, the Privacy Policy, and the Cookie Policy.

4.3. The User/Client has limited access, for personal purposes only (browsing, obtaining information, placing online orders) to the Site and is not entitled to download, partially or fully modify the Site, partially or fully reproduce the Site, copy, sell/resell, or otherwise exploit the Site for commercial purposes or purposes contrary to the Seller's interests.

4.4. All information used to describe the Goods available on the Site (static/dynamic images, multimedia presentations, etc.) does not constitute a contractual obligation on the part of the Seller, being used solely for presentation purposes.

5. MY ACCOUNT

5.1. Any User who visits the Site, is over 16 years of age, and meets the legal conditions for purchasing goods may create an account. Creating an Account is optional; Orders may also be placed as a guest.

5.2. When creating an Account, each User agrees to accept these Terms and Conditions and acknowledges the Privacy Policy and the Cookie Policy, being responsible for the accuracy of the information provided and for keeping it up to date.

5.3. To create an Account, the User enters their email address and follows the authentication steps specific to the Shopify platform. Within the Account, the User can view their order history and update their delivery and contact details.

5.4. Subscribing to the newsletter is optional and is done exclusively by ticking a separate checkbox, not pre-ticked by default, or by completing the dedicated subscription form.

6. THE ORDER

6.1. The Client/Buyer may place Orders on the Site by adding the desired Goods to the shopping cart, then completing the Order by going through the checkout steps. Once added to the shopping cart, a Good is available for purchase to the extent that stock is available for it.

6.2. How to place an Order: select the desired product and click the "Add to cart" button; go to the shopping cart and click the order completion button ("Checkout"); enter your contact details, delivery address, and, where applicable, billing address; select the delivery method; enter your payment details on the payment processor’s secure page; confirm the Order. Before completing the Order, you will tick the box confirming acceptance of the Terms and Conditions and will acknowledge the Privacy Policy.

6.3. By completing the Order, the Buyer confirms that all data provided by them, necessary for the purchasing process, is correct, complete, and true as of the date the Order is placed.

6.4. After the Order is submitted, the Buyer will receive an email confirming receipt of the Order, for information purposes. The Order is considered confirmed once the shipping confirmation email for the Order is received.

6.5. The Seller may unilaterally cancel an Order, with neither party being entitled to subsequently claim damages from the other, in the following cases: the data provided by the Client/Buyer is incorrect or incomplete; the transaction is not accepted by the card-issuing bank; the transaction is not validated by the payment processor; in the case of a suspicious or flagged transaction; or in the case of other objective reasons. Amounts collected for cancelled Orders are fully refunded.

6.6. The Client/Buyer may cancel an Order in writing, at the email address contact@cashmerearoma.com, until the shipping confirmation email for the Order is received.

6.7. If a product is not available in stock, the Buyer will be notified by email. In this case, the Buyer will be informed of the new delivery timeframe and may choose to wait or to cancel the Order, with a full refund of any amounts paid.

7. PRODUCT PRICES, INVOICING, AND PAYMENTS

7.1. We reserve the right to change product prices without prior notice. The purchase price shown on the invoice will be the same as that in effect at the time the confirmed Order was placed.

7.2. The Seller may display on the Site products benefiting from promotional prices for a certain period of time and within the limits of available stock.

7.3. Delivery charges are shown separately, before the Order is completed. Further details about delivery costs can be found in the Delivery Policy.

7.4. Payment for ordered products is made exclusively online, by bank card (Visa, Mastercard, etc.), through the payment processor Shopify Payments, or through the payment services Google Pay, Apple Pay, and Shop Pay. Card data is processed exclusively on the secure servers of the payment processor or of the chosen payment service provider. The Seller does not store and does not have access to your card details.

7.5. Prices are displayed, and payment is made, in the local currency of the Buyer's country (automatically detected), with currency conversion carried out through Shopify Payments; amounts are collected by the Seller in EUR. The Seller assumes no liability for any additional costs incurred by the Buyer as a result of bank card transactions (e.g., a currency conversion fee applied by the issuing bank where the card's issuing currency differs from the payment currency), the Buyer being solely responsible for such costs.

7.6. By submitting the Order, the Buyer agrees to receive the tax invoice in electronic format, by email, at the email address provided in the Order. Tax invoices may be issued to an individual or to a legal entity; to have the invoice issued to a legal entity, please complete the company details in the billing section when placing the Order.

7.7. In the case of online payment, the transaction will appear on the account statement under the name "Cashmere Aroma Global."

8. DELIVERY OF GOODS

8.1. Products are delivered from the Seller's warehouse in Bucharest, Romania, to countries in the European Union, as well as to Switzerland and the United Kingdom, through the Innoship shipping platform, which automatically selects, depending on the destination and the characteristics of the parcel, one of the following courier partners: Packeta, DPD, GLS, or FedEx. These may in turn work with local delivery subcontractors, depending on the destination country.

8.2. Delivery time ranges between 1 and 21 business days from confirmation of the Order, depending on the destination country and the shipping option chosen by the Buyer.

8.3. Delivery costs are shown when the Order is completed, before payment. The delivery rates and the order value thresholds above which delivery is free, for each destination country, are as follows:

8.4. For deliveries to destinations outside the European Union (Switzerland, United Kingdom), customs duties, import VAT, or other charges levied by the authorities of the destination country may apply. These are not included in the product price or delivery rate and are borne by the Buyer.

9. WARRANTIES. PRODUCT CONFORMITY

9.1. The Seller does not provide any additional commercial warranty for the products sold on the Site.

9.2. Regardless of any commercial warranty, all products sold on the Site benefit from the statutory guarantee of conformity provided by Emergency Ordinance no. 140/2021 on certain aspects concerning contracts for the sale of goods: the Seller is liable to the consumer for any lack of conformity existing at the time of delivery of the goods and which becomes apparent within 2 years from that date. In the event of non-conformity, the consumer is entitled, under the conditions of the law, to have the product brought into conformity (repair or replacement), to a proportionate price reduction, or to termination of the contract and a refund of the price paid.

9.3. If a delivered product does not match the image or description on the Site, or was damaged during transport, the Client/Buyer has the right to request its replacement or to return the product received and receive a refund of its value, without incurring any additional costs. Please report any non-conformity to us as soon as possible after receiving the parcel, at contact@cashmerearoma.com, attaching relevant photographs.

10. RIGHT OF WITHDRAWAL AND RETURN OF PRODUCTS

10.1. In accordance with Emergency Ordinance no. 34/2014 on consumer rights within contracts concluded with professionals, the individual Buyer (consumer) has the right to withdraw from the Contract, without giving any reason, within 14 calendar days from the date of taking physical possession of the products.

10.2. Exception: pursuant to Article 16(e) of Emergency Ordinance no. 34/2014, the right of withdrawal cannot be exercised for unsealed products which are not suitable for return due to health protection or hygiene reasons (a category which includes unsealed perfumes and cosmetic products). Therefore, only returns of sealed products, in the condition in which they were received, are accepted.

10.3. The intention to withdraw may be communicated by: (a) the return form available on the Site; (b) the online withdrawal function provided for in Article 11¹ of Emergency Ordinance no. 34/2014 — the "Withdraw from the contract here" button, permanently available on the Site during the withdrawal period: complete the withdrawal statement (name, order identification details, email address), click the "Confirm withdrawal" button, and the Seller will automatically send you, without delay, an acknowledgment of receipt of the statement, on a durable medium (email), including the content of the statement and the date and time it was submitted; or (c) any other unequivocal statement sent to the email address contact@cashmerearoma.com.

10.4. The direct cost of returning the products (return shipping and, where applicable, related charges) is borne by the Buyer.

10.5. The Seller will refund all amounts received as payment from the Buyer, including, where applicable, the cost of the initial standard delivery, without undue delay and in any event within 14 calendar days from the date on which the Seller was informed of the decision to withdraw, using the same payment method used by the Buyer for the original transaction. The Seller may withhold the refund until the returned products have been received, or until proof of their return shipment has been provided, whichever is earlier.

11. NEWSLETTER

11.1. Commercial communications (newsletter) are sent exclusively on the basis of the prior, express, and freely given consent of the data subject (a consent box not pre-ticked by default, or a dedicated subscription form).

11.2. Each communication sent includes a simple and free unsubscribe option (unsubscribe link). Withdrawal of consent takes immediate effect for the future.

12. CONFIDENTIALITY

12.1. CASHMERE AROMA GLOBAL S.R.L. is a personal data controller and will keep confidential the data you provide: first name, last name, email, phone number, delivery address, country, billing details, as applicable. The Seller will ensure the security of the data provided and will take technical and organizational measures for its effective management, strictly for the stated purposes.

12.2. Data is processed mainly for the following purposes: registering and processing the Order; issuing the invoice and verifying payment; transmitting the necessary data to the courier company for shipment of the Order; managing return requests and contract withdrawal statements.

13. LIABILITY. FRAUD

13.1. By creating and using an Account, the User/Buyer assumes responsibility for maintaining the confidentiality of their Account credentials (username and password) and for managing access to their Account and, to the extent permitted by applicable law, is responsible for the activity carried out through their Account.

13.2. The following will be considered attempted fraud or fraud: accessing data of any kind belonging to another User/Client/Buyer; altering or modifying the content of the Site or correspondence sent by the Seller; affecting the performance of the server on which the Site runs. In any of these situations, the Seller reserves the right to refer the matter to the competent authorities.

14. DISPUTES. APPLICABLE LAW

14.1. This contract is governed by Romanian law, without prejudice to the rights that consumers in other European Union member states benefit from under the mandatory provisions of the law of their country of habitual residence.

14.2. Any disputes arising between the Seller and Users/Buyers will be resolved amicably or, if this is not possible, will be settled by the competent courts of law.

14.3. Consumers may also refer the matter to the National Authority for Consumer Protection – A.N.P.C. (anpc.ro) and to alternative dispute resolution (ADR) entities, under the conditions of the law.
